What are the main industries that your business solicitors work with?
At Barker Gotelee we don’t specialise in any one market or any one area of law. Our well qualified team of business solicitors have extensive knowledge across a whole spectrum of industries including but not limited to farming, hotel and restaurants, road haulage, fashion, building, professional negligence and personal injury. However, the types of issues we commonly deal with – such as contractual or financial – can occur in any industry.
What legal services for businesses do you provide?
Our business solicitors specialise in the setting up of new businesses including sole traders, Partnerships, LLPs and Limited Companies.
This can include tailored terms & conditions for your business, shareholder agreements or advice on what type of company structure to set up with.
We specialise in dispute resolution of any type, including but not limited to professional negligence, partnership disputes, shareholder disputes, breach of contract issues and partnership exits. And our business solicitors also specialise in mediation, arbitration and employment tribunal work. We can also assist you if you wish to sell your business.
You’re based in Martlesham Heath, Ipswich. How far afield do you work from there?
We do not limit ourselves to any one area of England and Wales – our team of business solicitors has clients nationwide and we are happy to welcome anyone as a client regardless of where they are based. And when it comes to farming issues, our agricultural team specialise in European law as well. We are not, however, able to advise on Scottish law.
And if it is not convenient for you to come to us, our business solicitors are available to come to your premises.
I’m just starting out in business, what business legal services will I need?
As a new business it can be daunting to know what you need. Our business solicitors can advise you on what business structure to use and whether or not you will need any further documents to ensure you and your business are protected.
This can include a Shareholders Agreement, Partnership Agreement, Employment Contracts or Terms & Conditions.
We can also advise on how to protect any company intellectual property including logos and website content.
Our business is expanding. How can you help us?
From debt recovery services through to dispute resolution, our business solicitors are on hand to ensure that everything is in order before you commence your expansion plans.
As your business grows, so will your workforce. Our team of business solicitors can also help with your human resource needs, such as formulating employee contracts and writing staff handbooks.
And when it comes to the purchase of your new company premises, we can offer advice and guidance to keep everything moving in the right direction.
Can you help with buying or selling a business?
We are more than happy to assist you in the selling or buying of a business whether it be an Asset Sale or Share Sale. Our business solicitors services include assisting with due diligence, drafting of documents including Disclosure Letters, Sale Agreements, Purchase Agreements and all the subsequent considerations that may arise once you own the business.
We run a family business and so my business legal requirements cross over with my personal legal needs – can you deal seamlessly with both?
When you choose Barker Gotelee you will have the benefit of a full service firm with the knowledge and experience to help you with all your business needs as well as any personal issues for which you may need guidance.
Offering advice on family matters, as well as wills and probate matters which may arise, our business solicitors also have extensive experience in conveyancing should you be looking to sell or purchase a home.
There are many different pieces of legislation to keep abreast of – how do you ensure that your business solicitors know all there is to know about changes that are happening?
All solicitors are expected to maintain their legal knowledge by attending regular training on new developments in the relevant law that they advise on. This is regulated by the Law Society. At Barker Gotelee we are meticulous in ensuring that our knowledge is as up-to-date as possible.
How do you charge for your business legal services?
How a job is charged for will depend on what it is we are advising you on. Matters such as a simple will or a house sale or purchase tend to be charged as fixed fees plus any additional costs (such as Land Registry searches) and VAT.
For more complex jobs such as Court proceedings or the sale or purchase of a business we will provide you with an estimate of costs based on the hourly rate of the person who will be carrying out the majority of your work.
We will then keep you updated on costs as the matter progresses and should something happen which leads to the estimate being changed (either up or down) we will let you know.
Alternatively if you ever wish to know the costs that you have accrued at any given time our business solicitors will be more than happy to let you know.
