‘The government hopes that mediation is going to take a leading role in the resolution of family disputes going forward. It is soon going to become compulsory for people to have a meeting with a mediator to find out what mediation is all about before people will be able to apply to the court for a family-related court order. Quite apart from the prevailing belief that mediated agreements work best for families, the government hopes to stem the tide of self-represented parties appearing before the court in family and divorce disputes.
Legal aid will remain available for mediation, but otherwise only for family disputes relating to child abduction, forced marriage and where there has been a certain level of domestic violence.’
