Law Commission review into Wills
In 2015, the Law Commission is going to review four areas in relation to Wills with a view to increasing the percentage of individuals who make Wills, and reducing litigation over disputed Wills.
The four themes are:
- the mental capacity test for making a Will;
- correcting mis-drafted Wills after someone has died;
- reviewing the formalities for a valid Will; and
- mutual Wills – where a couple agree with each other not to change their Wills.
This is excellent news and final recommendations are expected in 2018.
