Law Commission review into Wills

Nick Palmer

In 2015, the Law Commission is going to review four areas in relation to Wills with a view to increasing the percentage of individuals who make Wills, and reducing litigation over disputed Wills.

The four themes are:

  1. the mental capacity test for making a Will;
  2. correcting mis-drafted Wills after someone has died;
  3. reviewing the formalities for a valid Will; and
  4. mutual Wills – where a couple agree with each other not to change their Wills.

This is excellent news and final recommendations are expected in 2018.
