‘Essex County Council has successfully applied to the Court for an Order to sell an elderly man’s house in order to pay for the cost of his residential care. The elderly man, who suffers from dementia, lacks sufficient mental capacity to manage his own financial affairs. The man’s son, who continued to live in his father’s house rent-free, had refused to agree to a sale and whilst he formally objected to the Council’s application, the Court ruled against him and also ordered that he pay the Council’s legal costs.’
