‘Mr Duffy intended to leave his estate for the general benefit of the staff and residents at a care home where he lived.
However, the terms of the legacy in his Will did not achieve this.
Accordingly, the gift failed altogether and Mr Duffy’s estate passed as if he had not made a Will – to his nephews, in this case.
