‘Following Lord Justice Jackson’s proposed reform on litigation costs, Ken Clarke has informed the House of Commons that ‘success fees’ will no longer be able to be claimed, by the lawyer, from the losing side. It has been suggested that the lawyer should receive a share of the damages, capped at 25%, instead. The Government hopes that the changes will act as a deterrent to anyone bringing ‘spurious cases’. However, the Justice Secretary has warned that the changes could ‘restrict access to justice’ for poorer claimants.’
