As a consumer the starting point is an assumption that products you have purchased are safe to use, however this is not always so and faulty products can sometimes cause serious injury to those that use them. In such circumstances the law provides the right to claim compensation.

Any claim for compensation will be based on a breach of the Consumer Protection Act 1987, in contract law or in the law of tort.

To be successful one must be able to prove that the product is defective, that the defective product caused some harm or loss and that the proposed defendant is legally responsible for the defective product in question.

It is important to note that Court proceedings for product liability claims must be issued within three years of the date of injury. However, if the injury happened longer than three years ago, it is possible to bring a claim if the injured person only discovered that the injury was caused by a defective product within the last three years.

Product Liability claims can be difficult to bring and so it is important that you seek independent legal advice from a solicitor at the earliest opportunity.
