Same sex marriage comes into force at midnight on 28th March 2014. For many couples this is the culmination of years of campaigning for equality but it will make little difference on a divorce if a couple are married or in a civil partnership. Same sex couples in civil partnerships follow the same process for dissolving their union as husbands and wives on divorce. A petition is filed with the court and eventually a decree is granted. The same financial considerations apply to the determination of the financial settlement. Getting married rather than entering a civil partnership simply allows a couple to be married in a religious ceremony rather than a civil one.
