January divorce boom

Every year the media repeats its standard mantra about ‘Divorce Day’ being the first working day in January. The implication is that couples fall out over their turkey dinner and rush off to their solicitors as soon as legal practices open after the holiday.

Long years of experience tell us that this assumption is wrong and belittles the amount of soul-searching that many couples go through before deciding to call time on their marriages.

The basis for the media statements is that the number of divorce petitions issued in January is more than in other months, but most of those petitions will have been drawn up as result of separations the previous year.

Few couples rush into filing petitions immediately even if they have fallen out over the Christmas period and we would never encourage clients who have had a traumatic falling out to issue a petition without coming to terms with the situation first and giving them time to reflect on the right route to follow.
