If a discrimination claim is successful, then the risks to your business are very high. There is no financial cap on the compensation an Employment Tribunal can award. Awards can also be made for injury to feelings and for personal injury.

Successful claims also have the potential to cause serious and irreparable damage to your reputation. All Employment Tribunal decisions are now published online. These decisions can be read by your current and prospective employees and by your customers and business contacts.

Discrimination claims can be made without any length of service requirement. Claims can be made by prospective employees (who have never been employed) in response to a discriminatory advert, or badly conducted interview or selection day. Claims can also be made by workers.

To succeed, the person bringing the claim must establish they have suffered a detriment related to a protected characteristic. These protected characteristics include, by way of example, age, disability, race and sex.
